James O’Keefe and Cam Higby face felony charges over their conduct at Minnesota polling places in August.

Two conservative activists who filmed themselves at Minnesota polling places during the state's August primary have been charged with felony unlawful voting and identity theft. James O'Keefe and Cam Higby are accused of using the names of registered voters without permission while trying to test Minnesota's voter-vouching process. They did not sign the required oath or receive ballots, according to the Hennepin County Attorney Mary Moriarty, who announced the charges on October 28.

Newsweek has contacted O'Keefe, Higby, the Hennepin County Attorney's Office, and Minnesota Secretary of State Steve Simon for comment by email outside of regular working hours. Moriarty accused the pair of entering polling places during the August 11 primary and identifying themselves using the names of registered voters in those precincts without the voters' knowledge or permission. "Both men stopped short of signing the oath we all sign before receiving our ballot," she said.

"But Minnesota law states clearly that no individual shall intentionally misrepresent their identity in applying for a ballot." The charges focus on the men's alleged conduct while applying for ballots. Prosecutors say they intentionally misrepresented their identities during that process, although neither signed the oath or cast a ballot. This is a developing story.
