Maurene Comey, the daughter of former FBI Director James Comey, was unlawfully fired from her job as a federal prosecutor in New York last year, a federal judge ruled Monday. Furman, appointed in 2012 by former President Barack Obama, ruled that Comey’s July 2025 termination violated federal law and granted her retroactive reinstatement and back pay through December 20, 2025, when the court said she appeared to have accepted another job. Comey spent nearly a decade as an assistant U.S. attorney in Manhattan, working on several high-profile cases, including the Sean "Diddy" Combs trial.
After her dismissal, she sued the Justice Department and other defendants, alleging violations of the separation of powers and her constitutional rights. Comey alleged that she was fired because she is the daughter of James Comey, a longtime foe of President Donald Trump, or because of her perceived political affiliation and beliefs. In a 55-page ruling, Furman rejected the government’s argument that limits on the removal of federal prosecutors unconstitutionally intruded on presidential power.
The judge said the government’s position “flies in the face of nearly two centuries of Supreme Court precedent” and that accepting it would risk unsettling “the very equilibrium established by this Nation’s constitutional system.” Newsweek has reached out to the DOJ and Comey's attorneys via email on Monday afternoon for comment.
